Contact partners for restitution claims

In ac­cor­dance with the agree­ment be­tween the Fed­er­al Re­pub­lic of Ger­many (Fed­er­al Gov­ern­ment Com­mis­sion­er for Cul­ture and the Me­dia), the Free State of Bavaria and the Kun­st­mu­se­um Bern Foun­da­tion (Ger­man ver­sion on­ly) dat­ed 24 Novem­ber 2014, the “Gurlitt Prove­nance Re­search” project is the con­tact part­ner for in­quiries re­gard­ing the in­ves­ti­ga­tion of the col­lec­tion un­til the project’s ter­mi­na­tion. As soon as the project com­pletes re­search on a par­tic­u­lar work and a cor­re­spond­ing prove­nance re­port is is­sued, the Fed­er­al Gov­ern­ment Com­mis­sion­er for Cul­ture and the Me­dia is the con­tact part­ner for resti­tu­tion claims con­nect­ed to the re­spec­tive work:

Doc­u­ments re­quired in cas­es of pos­si­ble resti­tu­tion

For le­gal rea­sons and to pro­tect the right­ful ben­e­fi­cia­ries, it is nec­es­sary to pro­vide the fol­low­ing doc­u­ments, sub­stan­ti­at­ing one’s le­gal en­ti­tle­ment to the in­her­i­tance or right to rep­re­sent the law­ful heirs:

  • A no­tarised copy of the tes­ta­ment (if one ex­ists) from whom the work was con­fis­cat­ed through Nazi per­se­cu­tion. In the case of a for­eign tes­ta­ment, an apos­tille and no­tarised trans­la­tion of the tes­ta­ment or re­spec­tive cer­tifi­cate of in­her­i­tance (or if sub­ject to for­eign law, then a for­eign cer­tifi­cate of in­her­i­tance);
  • No­tarised copies of all oth­er rel­e­vant tes­ta­ments (for for­eign tes­ta­ments, apos­tilles and no­tarised copies) for all de­ceased le­gal heirs re­lat­ed to this per­son or the re­spec­tive cer­tifi­cates of in­her­i­tance (or if sub­ject to for­eign law, then for­eign cer­tifi­cates of in­her­i­tance);
  • No­tarised cer­tifi­cates of orig­i­nal pow­er of at­tor­ney (for for­eign cer­tifi­cates, apos­tilles) of all le­gal heirs named and sub­stan­ti­at­ed by the doc­u­men­tary ev­i­dence list­ed above, which en­ti­tle the rep­re­sen­ta­tive of the claimant to ex­e­cute trans­ac­tions and is­sue state­ments in ref­er­ence to the resti­tu­tion of the re­spec­tive work and ac­cept the work should resti­tu­tion be grant­ed.

Ad­di­tion­al doc­u­ments may be re­quired in in­di­vid­u­al cas­es.
